Terms and conditions
The Foster and Kinship Carer Card is a scheme administered by the State of Queensland through the Department of Child Safety (referred to as the state) where business providers, in recognition of the community service provided by foster carers, agree to provide offers or discounts (submitted to the state for prior approval) (the offer) to holders of a Foster and Kinship Carer Card whilst the business provider retains approved business membership in the scheme.
In consideration for the state approving the business provider's business membership in the Foster and Kinship Carer Card scheme the business provider:
- accepts responsibility for and warrants that it will ensure that the offer will be readily available to Foster and Kinship Carer Card holders
- agrees to display the Foster and Kinship Carer Card logo in a prominent place in all business outlets that participate in the agreed offer
- shall not represent that the state or its contractors are the provider or supplier of the offer
- acknowledges that business membership of the scheme creates no legal relationship of partnership or agency between the state and the business provider
- acknowledges that the state and its contractors make no representation that any minimum number of sales will result from participation in the scheme
- warrants to the state and its contractors that the offer will conform with the description approved by the state and that products or services sold shall be free from defects in materials or workmanship and will be fit for the purposes for which the offer is purchased by the customer
- agrees that the offer may not be changed or substituted without the prior written consent of the state
- agrees to keep the state and its contractors fully indemnified against any costs (including legal fees), claims, damages, and expenses that may be incurred by the state and/or its contractors as a result of the business provider failing to perform its obligations under this agreement and/or in connection with the supply, or any failure to supply, the offer
- consents to the making of enquiries by the state and the exchange of information with the Office for Fair Trading and other authorities regarding its trade activities and any other matters relevant to this agreement
- agrees that approved business membership in the Foster and Kinship Carer Card scheme ceases when the business provider's offer is withdrawn or is no longer available to card holders
- agrees to immediately remove all Foster and Kinship Carer Card logos from display and remove or withdraw all advertising material containing references to Foster and Kinship Carer Card, when business membership in the Foster and Kinship Carer Card scheme ceases
- agrees that business membership may be withdrawn by the state where the business provider fails to comply with relevant legislative provisions, regulatory guidelines, codes of conduct and standards as are appropriate to the industry or business
- acknowledges that the state can refuse, at its discretion, to admit applicants to the scheme
- agrees to contact the state when wishing to withdraw from the scheme.
