Child Protection Regulation 2000
The Child Protection Regulation 2000 is subordinate legislation to the Child Protection Act 1999.
The following outline indicates the key parts of the regulation:
- Part 1 provides a short title for the regulation.
- Part 2 covers matters related to the licensing of care services, including:
- independent evaluation of a care service
- requirement for licensee to have a policy about reporting matters of concern
- requirement for licensee to keep records and allow access by the chief executive
- provision for a licensee to report to the chief executive about the records the licensee is required to keep
- suitability of methods for selection, training and management of people engaged in providing care services.
- Part 3 covers matters about children in care, including:
- agreement to provide care for a child
- matters to consider before telling parents about a child placed in care
- Part 4 defines a suitable person.
- Part 5 covers matters the chief executive must consider in deciding whether to approve publication of information about children.
- Part 6 covers miscellanous matters, including:
- reporting harm to a child in departmental and licensed care services
- requirement for the chief executive to keep records
- information to be given to the Commissioner for Children and Young People.
- Schedule 1 lists relevant child welfare laws in other states and territories plus New Zealand.
- Schedule 2 lists participating states and territories, the relevant interstate law and the interstate officer responsible for that law.
