Legislation
Our department administers the following legislation. This legislation governs our activities, providing the framework within which we operate to protect Queensland's children and young people:
- Adoption of Children Act 1964
- Adoption Act 2009 (to commence in early 2010)
- Child Protection Act 1999
- Child Protection (International Measures) Act 2003
- Childrens Court Act 1992 (ss 20(1)(f), 20(2)(a)(ii)) - jointly administered with the Minister for Communities, Minister for Disability Services Queensland, Minister for Aboriginal and Torres Strait Islander Partnerships, Minister for Seniors and Youth.
- Family Services Act 1987 - jointly administered with the Minister for Communities, Minister for Disability Services Queensland, Minister for Aboriginal and Torres Strait Islander Partnerships, Minister for Seniors and Youth.

- Children Services Tribunal Act 2000
- Commission for Children and Young People and Child Guardian Act 2000
- Crime and Misconduct Act 2001
Surrogacy legislation now administered by Department of Justice and Attorney-General
In May 2009, responsibility for administration of the Surrogate Parenthood Act 1988 was transferred to the Department of Justice and Attorney-General.
The Queensland Government has released a position paper outlining a model for the decriminalisation of altruistic surrogacy and the transfer of parentage. More information is available through the Department of Justice and Attorney-General’s website.
